Privacy Policy

This Privacy Policy explains our practices regarding the collection, use, and disclosure of the information we process to provide our Services. This Privacy Policy does not apply to any third-party websites, services, or applications, even if they are accessible through our Services.

​​This Privacy Policy describes our practices regarding information collected through our websites (easymate.ai, easymate.io, their subdomains, and any other website where our Terms of Service are posted), the EasyMate Apps, the Platform, and other services we provide (collectively, the "Service").

By using the EasyMate Service, you consent to this Privacy Policy and our Terms.

1. Definitions

"Direct User" means an individual with a EasyMate account who can build EasyMate apps.

“End User” means users of EasyMate App when they are made available to members of the public.

“EasyMate App” means custom AI-powered applications built on the EasyMate platform by Direct Users.

“EasyMate App Owner” means the administrator of a EasyMate App

​​2. What Information We Collect and How

End Users. We do not collect personal data directly from End Users unless they contact us. Each individual operator of a EasyMate App determines what End User information they collect and is responsible for compliance with applicable laws. However, the Automatically-Collected Information via Technology section below applies equally to End Users and Direct Users.

Direct Users. We collect information from you when you:

  • Create or register an account, or administer your account
  • Input, post, or upload information, data, or other content through the Services
  • Submit questions, requests, or other communications to us via various communication channels
  • Contact us for customer support or technical support
  • Visit any of our websites or download any of our applications
  • Participate in promotions, user conferences, webinars, demonstrations, contests, sweepstakes, surveys, or other marketing events
  • Participate in research activities
  • Interact with other users of the Services and guests on our community forums
  • Integrate third-party products and services with your account on our Services

We also collect information about you from our business partners, including referral partners and resellers, and third parties that help us with sales and marketing efforts, such as prospecting. We may also obtain publicly available business contact information.

Below is additional information about what we collect, depending on how you interact with the Services:

2.1 Your Content

“Content” includes all information, data, and other content, in any form or medium, that is collected, downloaded, or otherwise received, directly or indirectly, from you (or on your behalf) by or through the Services. It also includes information you provide when connecting a third-party account, product, or service to the Services. You (and anyone who can interact with your use of the Services) own and control the nature of any Content, subject to any applicable terms and conditions, including our Terms of Service and this Privacy Policy. Our collection, use, and disclosure practices with respect to Content are distinct from those with respect to other sorts of information, as explained in Section 2.2 below

We may upload Content automatically with your authorization from third-party services (such as from your Google Drive). See Section 2.3 below.

2.2 Direct User Information

“Direct User Information” consists of information related to your access or use of our Services, the creation of accounts, or that otherwise identifies you as a direct user of the Services. Direct User Information includes:

  • Identifiers. This includes your name, mailing address, email address, postal code, telephone number, and other similar identifiers.
  • Customer Records. This includes username and password, payment information, company name, job title, business email address, and department.
  • Protected Classification Characteristics. This includes age and gender.
  • Commercial Information. This includes information about products or services purchased, obtained, or considered.
  • Internet/Network Activity Information. This includes your browsing history, log and analytics data, information about the device(s) used to access the Services, domain server, search history, and information regarding your interaction with our Services, and other usage data.
  • Audio/Visual Information. This includes pictures you provide or upload in connection with our Services, and the content and audio or video recordings of phone or video calls between you and us that we record, where permitted by law.
  • Profession/Employment Information. This includes your current employer, title, and location.
  • Other Personal Information. This includes personal information you provide to us in relation to a survey, comment, question, request, or inquiry, and information you provide when you connect a third-party account, product, or service to the Services.
  • Inferences. This includes inferring your location using your IP address, or using data from your use of our Services to make predictions about your preferences, characteristics, psychological trends, predispositions, behavior, attitudes, intelligence, abilities, and aptitudes.

If you are an end user using the Services through an account created on your behalf by another of our customers (such as an employer, an organization of which you are a member, or another individual that uses our Services), we may collect and process Direct User Information about you on behalf of the customer with whom your use of the Services is associated.

2.3 Third-Party Integrations

If you create your account using a service provided by a third party, such as Google or Apple, or a single-sign-on service provided by a third party such as Okta, we may collect Direct User Information about you from the third-party service (such as your username or user ID associated with that third-party service). If you create your account using such a third-party service, or if you give us permission by changing the settings on your EasyMate Account, we may also collect, and you authorize us to collect, information about your personal contacts as may be stored within that third-party service, which we may use to facilitate your invitation of collaborators to our Services. By choosing to create an account using a third-party service, you also authorize us to collect Direct User Information necessary to authenticate your account with the third party.

Certain aspects of the Services allow you to link or integrate third-party products and services to enable certain features and functionalities with the Services. For example, you can connect your Google Drive account to generate Content in the Services from information and data contained in your Google Drive or integrate with third-party services using our applications or extensions. If you choose to use these features or functionalities, you may be asked to create an account with a third party that provides such features or functionalities or link your existing third-party service account with the Services (and, by doing so, agree to the privacy policy and/or terms and conditions of that third party). You may also be asked to authorize the Services to collect information from a third party on your behalf. We will then collect information (such as your username or user ID associated with that third-party service) from you and/or that third party as necessary to enable the Services to access your data and content stored with that third-party service. Once the authentication is complete, we have the ability to access information you provided to us or that was otherwise collected by the third-party service in accordance with the privacy practices of that third party. We will store the information and data we collect and associate it with your EasyMate Account, and we will use that information and data to enable the integration of the Services with the third-party service and to perform actions requested or initiated by you, or that are reasonably necessary to carry out instructions provided by you.

2.4 Automatically Collected Information via Technology

We collect information about how you use the Services and your actions on the Services, including your IP addresses, browser types, operating systems, ISPs, platform types, device types, and mobile device identifiers such as make and model, and mobile carrier. We may also use tools, including third-party tools, to collect analytics data. Some of this information is collected through the use of cookies and other tracking technologies, such as web beacons, pixels, session replay scripts, and similar technologies. 

Below is additional information about what we collect via Technology, depending on how you interact with the Services:

  1. Server Information: To make the Service more useful to you, our servers (which may be hosted by a third party service provider) collect information from you, which may include your browser type, operating system, Internet Protocol (“IP”) address (a number that is automatically assigned to your computer when you use the Internet, which may vary from session to session), domain name, and/or a date/time stamp for your visit.
     
  2. Log Files: Like most websites, we automatically collect IP addresses, browser type, Internet Service Provider, referring/exit pages, operating system, timestamps, and clickstream data. We use this information to analyze trends, administer the Service, track users’ movements around the  Service, gather demographic information about our user base as a whole, and better tailor the  Service to our users’ needs. Except as noted in this Privacy Policy, we don't link this automatically-collected data to personal data.
  3. Do Not Track Signals: We don't currently respond to "do not track" signals other mechanisms that might enable you to opt out of tracking on our site. To find out more about “do not track,” visit http://www.allaboutdnt.com.
  4. Mobile Services: We may collect non-personal data from mobile devices, including location and device information, to deliver relevant content and improve performance. If the Service crashes on your mobile device, we may receive information about your mobile device model software version and device carrier, which allows us to identify and fix bugs and otherwise improve the performance of the Service. This information is sent to us as aggregated information and cannot be used to identify an individual. 
  5. Analytics Services: In addition to the tracking technologies we place, other companies may set their own Cookies or similar tools when you use the Service. This includes third party analytics services, like Google Analytics, Full Story, etc (“Analytics Services”), that we engage to help analyze how users use the  Service, as well as third parties that deliver content or offers. We may receive reports based on these parties’ use of these tools on an individual or aggregate basis. We use the information we get from Analytics Services only to improve the  Service. The information generated by the Cookies or other technologies about your use of the service (the “Analytics Information”) is transmitted to the Analytics Services. The Analytics Services use Analytics Information to compile reports on user activity. The Analytics Services may also transfer information to third parties where required to do so by law, or where such third parties process Analytics Information on their behalf. Each Analytics Services’ ability to use and share Analytics Information is restricted by such Analytics Services’ Terms of Use and privacy policy. By using the Service, you consent to the processing of data about you by Analytics Services in the manner and for the purposes set out above. We may also partner with ad companies to support our marketing efforts, including by serving you ads better tailored to your likely interests. If you don’t want to take advantage of these services, you can opt out by visiting http://www.aboutads.info/ or http://networkadvertising.org/choices/, or, if you are located in the EU, http://www.youronlinechoices.eu/.  
  6. Social Media Login: Direct Users may use certain social media site (“SNS”) credentials to log into the Service; in such a case, we collect personal data from the social media website. For example, when you log in with your Google credentials, we may collect the personal data you have made publicly available in Google, such as your email address, name, and profile picture/logo. You are solely responsible for your use of the SNS and it is your responsibility to review the terms and privacy policy of such SNS. Any information that we collect from an SNS account will depend on the privacy settings you have with that SNS, so please consult the SNS’s privacy and data practices. We will not be responsible or liable for: (a) the availability or accuracy of such SNS; (b) the content, products or services on or availability of such SNS; or (c) your use of any such SNS. You can revoke our access to this information anytime by amending the appropriate settings from within your account settings on the applicable SNS.

3. Cookies

Cookies are small text files stored by your web browser when you visit certain websites or mobile properties. We use Cookies in our Service for the purposes of facilitating your use of our Service, customizing your browsing experience, tracking usage trends and patterns, and delivering targeted ads.

3.1 What types of Cookies does EasyMate use?

Our Service uses “first-party Cookies” (i.e., Cookies served by us) and “third-party Cookies” (i.e., Cookies served by third parties that we work with).

Cookies are unique to your account or your browser. Session-based Cookies last only while your browser is open and are automatically deleted when you close your browser. Persistent Cookies last until you or your browser deletes them or until they expire.

Our uses of Cookies fall into the following general categories:

  • Strictly-Necessary. We use Cookies that allow you access to our Service; are required to identify irregular site behavior, prevent fraudulent activity, and improve security; and allow you to make use of our functionality.
  • Functionality-Related. We may use Cookies that allow us to offer you enhanced functionality when accessing or using our Service, including, for example, identifying you when you sign into our Service or keeping track of your specified preferences, interests, or past items viewed.
  • Analytics and Performance-Related. We may use Cookies to assess the performance of our Service and, as part of our analytic practices, to help us understand how you use the Service. These Cookies are used to collect information about traffic to the Service, and do not identify any individual visitor. The information is aggregated and anonymous. It includes the number of visitors to our Services, the websites that referred them to our Services, the pages they visited on our Services, what time of day they visited our Services, whether they have visited our Services before, and other similar information. 
  • Advertising- or Targeting-Related. We may use first-party or third-party Cookies to deliver content, including ads, relevant to your interests, on our Service or on third-party sites.
  • Social Media Cookies: these Cookies are used when you share information using a social media sharing button or “like” button on the Service or you link your account or engage with our content on or through a social networking website such as Facebook, X, LinkedIn, etc. The social network will record that you have done this.

3.2 Does EasyMate use Cookies for interest-based advertising?

Yes. We work with third-party partners like online advertising networks, social media companies, and other third-party services that use Cookies, or other information in connection with use of our Service, in order to display personalized or interest-based ads on the Service, on other websites, through apps or services you may use, and on other devices or browsers you may use. We and our third-party partners use this information to make the advertisements you see online more relevant to your interests, as well as to provide advertising-related services such as reporting, attribution, analytics, service optimization, and market research. These Cookies typically contain a pseudonymous cookie ID and collect device metadata, such as IP address and user agent string, and actions on the Service to assist with these advertising and related services. Please note that the information we share with those advertising networks might be combined with other information about you that those networks may have collected from us or other sources.

3.3. How do I manage Cookies?

a. How do I manage Cookies used by EasyMate?

Depending on your region, a pop-up window may appear the first time you visit our Service, informing you that our Service uses Cookies, and allowing you to set your cookie preferences for your device. Please be aware that this does not apply to strictly-necessary Cookies. Even if the pop-up window does not appear, you may indicate or change certain preferences by visiting our Cookie Preference Center, which may be accessed by clicking on "Cookie Preferences" in the footer of this webpage.

b. How do I opt out of Google data collection?

We may also use certain forms of display advertising and other advanced features through Google Universal Analytics, such as Remarketing with Google Analytics, Google Display Network Impression Reporting, the DoubleClick Campaign Manager Integration, and Google Analytics Demographics and Interest Reporting. These features enable us to use first-party Cookies (such as the Google Analytics cookie) and third-party Cookies (such as the Doubleclick advertising cookie) or other third-party Cookies together to inform, optimize, and display ads based on your past visits to the Service.

You may opt out of certain Google advertising products by visiting the Google Ads Preferences Manager, currently available at google.com/ads/preferences.

c. How do I opt out via self-regulatory programs?

You can opt out of advertising companies serving interest-based advertising to you by using the self-regulatory program opt-outs below (to the extent those companies participate in such industry opt-out pages).

To opt out of receiving interest-based ads from members of the Network Advertising Initiative, please visit https://thenai.org/opt-out/.

Opting out via the above mechanisms does not mean you will no longer receive online advertising. It means that the online ads that you do see from these self-regulatory program participants should not be based on your interests. We are not responsible for the effectiveness of, or compliance with, any third-party opt-out options or programs, or the accuracy of their statements regarding those options or programs. In addition, third parties may still use cookies or other tracking technologies to collect information about your use of our online services, including for analytics and fraud prevention as well as any other purpose permitted under those self-regulatory programs.

4. How We Use the Information We Collect

4.1 Use of Content

Notwithstanding anything to the contrary in this Privacy Policy, we will not use or access your Content except: to provide, maintain, improve, or optimize use of the Services; where you (or the organization through which you have an account) explicitly approve access (e.g., during a customer support inquiry or when participating in beta testing); in response to lawful requests by law enforcement or government authorities; in response to subpoenas, court orders, or other legal process or requests, as required by applicable law as determined in our discretion; where necessary (in our sole discretion) to ensure the stability and security of the Services and our systems (e.g., where we have reason to believe specific Content is degrading server stability); and where necessary (in our sole discretion) to protect the rights, privacy, safety, or property of you, us, or others. Notwithstanding the foregoing, you acknowledge and agree that we may retain, take possession of, delete, or deny you access to your Content if we believe, in our sole discretion, that some or all of your Content, or your use of the Services, violates our Terms of Service. We also may analyze metadata related to Content (such as total number of records, file size, API volume, access logs, etc.).

4.2 Use of Other Information

We use the information we collect for a variety of purposes, and how we use it depends on what we collect and which Services (or features of the Services) you use. These purposes may include:

  1. Fulfilling our Contract with You and Providing the Services to You. This includes use for the purpose of: (i) responding to requests or inquiries from you; (ii) providing customer support or technical assistance; (iii) contacting you to provide product updates or information about products you have requested or purchased; (iv) creating, managing, or administering your information and account, including identifying you with your EasyMate Account or the account of another EasyMate customer; and (v) auditing relating to interactions, transactions, and other compliance activities.

  1. Analyzing and Improving our Services Pursuant to our Legitimate Interest. This includes use for the purpose of: (i) deriving market insights, ways to improve the Services, and performing other business analysis or research; (ii) customizing existing and future product offerings and other aspects of the Services to you and other users; (iii) securing the Services and our systems, and protecting your information and data; (iv) detecting security incidents and protecting against malicious, deceptive, fraudulent, or illegal activity, and prosecuting those responsible for that activity; and (v) measuring interest in and engagement with our Services and short-term, transient use, such as contextual customization of ads.

  1. Marketing Our Products and Services. This includes use for the purpose of: (i) tailoring and providing you with information about EasyMate products, services, or events that you may be interested in, including by email or phone, (ii) monitoring the performance of our advertisements and marketing efforts, and (iii) communicating with you about your engagement with our Services.

  1. Legal Obligations and Rights. This includes use for the purpose of: (i) establishing, exercising, investigating, prosecuting, or defending against legal claims; (ii) complying with laws or responding to lawful requests and legal process; (iii) protecting our rights and property, and the rights and property of our agents, customers, and others, including to enforce our agreements, policies, or Terms of Service; (iv) detecting, suppressing, or preventing fraud; (v) reducing credit risk and collecting debts owed to us; (vi) protecting our health and safety, or the health and safety of our Services, our customers, or any person; or (vii) fulfilling other requirements under applicable law.

  1. Participation in any EasyMate partner program. This includes use for the purpose of enabling or supporting participation in any such program, which may involve the provision by EasyMate partners of implementation, training, app-building, base-building, or other similar services.

  1. Consent. This includes use for other purposes that are clearly disclosed to you at the time you provide personal information, or with your consent.

  1. Aggregated or De-Identified Data. This includes the use of aggregated or de-identified information for a wide variety of statistical, analytical, and service improvement purposes. The aggregation or de-identification process prevents the information from being reassociated or identified with any one customer account, user, or individual.

  1. Other Purposes. This includes use for our other legitimate business purposes or as permitted by applicable law.

5. How We Disclose Information

We disclose information we collect for specific purposes, including:

  • When you ask us to, or otherwise give your specific consent (for example, by posting Content using the Universe feature), you consent to our making that Content visible to users of our Services or website guests;
  • With affiliates and subsidiaries to provide you with aspects of the Services, such as customer support;
  • With vendors that help us provide you with aspects of the Services, such as data storage, hosting, customer support, and payment processing, or that help us with marketing and email campaigns, to advertise, gain insights, and perform analytics into how the Services are used and how they might be improved;
  • With third parties who enable certain features or functionalities of the Services that you’ve requested (for example, by installing extensions in the Services);
  • With an employer or other organization (or employees or other users of the Services associated with such an employer or other organization) on whose behalf you use the Services, that created an EasyMate Account on your behalf, or that owns, manages, or is associated with the email domain for an email address on your account;
  • With the owner or collaborator of a workspace on the Services to which you have access or on which you are a collaborator as necessary to identify you to such owner or collaborator or enable you to collaborate as intended;
  • With partners in any EasyMate partner program, when you elect to work with one of our partners for implementation, training, app-building, base-building, or other similar services.
  • As necessary to comply with applicable law, including governmental requests and law enforcement requests, and otherwise to protect the rights, privacy, safety, or property of you, us, or others;
  • As necessary in the event of a proposed or actual reorganization, merger, sale, joint venture, assignment, transfer, financing, or other disposition of all or any portion of our business, assets, or stock;
  • With others for any legitimate business purpose that does not conflict with the statements made in this Privacy Policy.

4. Transfers of Information

We may transfer to and process your personal information in countries outside of the jurisdiction where you are located for the various purposes described above. When required by law, we will ensure that we rely on an appropriate legal mechanism for the transfer, such as your consent, standard contractual clauses (or their equivalent), or adequacy decisions. You may ask us for more information about the specific basis we use for transferring your data by emailing us at privacy@easymate.ai.

5. Retention

We retain your data only as long as necessary to provide the Service or as required by law.

6. Managing Your Information

6.1 Content

You may access, correct, amend, or delete Content within the Services. You own all Content you upload, provided you have a lawful title thereto. Content you delete (including Content containing personal information) may be retained in archived or backup copies in order to enable you to use certain features like revision history and base snapshots. For instructions on how to permanently delete Content from your EasyMate Account, please contact us at privacy@easymate.ai. Please note that permanent deletion of Content through this process may impair or disable some features of the Services (such as revision history and base snapshots) with respect to that Content.

6.2 Other Information

We may use some of the information we collect for marketing purposes, including to send you promotional communications about new Services features, products, events, or other opportunities. If you wish to stop receiving these communications or to opt out of use of your information for these purposes, please follow the opt-out instructions by clicking "Unsubscribe" (or similar opt-out language) in those communications. You may also contact us at privacy@easymate.ai to opt out.

You also may have certain rights with respect to your data depending on the jurisdiction in which you live. Please see the jurisdiction-specific sections below for a description of those rights.

7.  AI Technologies

We may use AI technologies to enhance your experience on the Service, including to improve our services and develop new features. As described in our Terms, we provide access to certain AI Services and Tools as part of the Service. When you use EasyMate's AI Services and Tools, we process your Inputs and the Outputs (where applicable) in accordance with this Privacy Policy. This processing may involve your personal data. We may use the Input and Output from your interactions with EasyMate AI Services and Tools to train, refine, and develop EasyMate AI Services and Tools and otherwise improve the Service. When using personal data for AI development and training, we implement appropriate safeguards to mitigate potential privacy impacts.

EasyMate AI Services and Tools may utilize third-party AI Services as described in our Terms. When you use these features, your data may be processed according to both our Privacy Policy and the privacy policies of these services.

8. Third Party Sites

The Service may link to third-party websites and features not covered by this Privacy Policy. These third parties have their own privacy policies, and we do not accept any responsibility or liability for their websites, features, or policies. Review their privacy policies before submitting information to them.

9. Security

We use reasonable organizational, technical, and administrative measures designed to protect personal data within our organization. While no online service is 100% secure, we work very hard to protect information about you against unauthorized access, use, alteration, or destruction, and take reasonable measures to do so. Unfortunately, no transmission of information via the internet is completely secure. If you have reason to believe that your interaction with us is no longer secure, please notify us immediately.

By using the Service or providing personal data to us, you agree that we may communicate with you electronically regarding security, privacy, and administrative issues relating to your use of the Service. If we learn of a breach of personal data, we may attempt to notify you electronically or in writing as required by law.

10. Job Applicants

When you apply for a job with us, we collect the information that you provide in connection with your job application. This includes but is not limited to business and personal contact information, professional credentials and skills, educational and work history and other information of the type that may be included in a resume. This may also include diversity information that you voluntarily provide. We use this information for our legitimate business interests to facilitate recruitment activities and process employment applications, including for evaluating your candidacy, monitoring recruitment statistics, and responding to surveys.

 

We may also use this information to provide improved administration and as otherwise necessary (i) to comply with relevant laws or to respond to subpoenas or warrants served on us, (ii) to protect and defend our or others' rights or property, (iii) in connection with a legal investigation and (iv) to investigate or assist in preventing any violation or potential violation of the law, this Privacy Policy or our Terms.

For information about your rights under applicable state law, please refer to the Your Privacy Rights section of this Privacy Policy, which applies to job applicants as well as Direct Users.

11. Information from Children

Our Services are not intended for use by children under the age of 13 (or other age as required by local law), and we do not knowingly collect personal information from children. If we learn that we have collected personal information from a child, we will take reasonable steps to delete such information from our files as soon as is practicable. If you learn that your child has provided us with personal information without your consent, you may contact us at privacy@easymate.ai.

12. Sensitive Personal Data

Please do not send us Sensitive Personal Data (e.g., social security numbers, racial/ethnic information, political opinions, religious beliefs, health data, biometrics, criminal background). If you include Sensitive Personal Data in user-generated content submitted through the Service, you consent to our processing and use in accordance with this Privacy Policy. If you do not consent to our processing and use of such Sensitive Personal Data, you must not submit it.

12. Your Privacy Rights

The following rights may be available to you, including if you are in the EEA, Switzerland, or the UK.

  • Opt-out: Request to opt out of direct marketing, automated decision-making/profiling, sensitive data collection, new processing beyond the original purpose, or data transfers outside the EEA, where we rely on your consent for such transfer. Please note that your use of some of the Service may be ineffective upon opt-out.
  • Access: Request access to the information we hold about you.
  • Correction: Request updates or corrections to inaccuracies in your data.
  • Portability: Request that we move your data to other service providers.
  • Deletion: Request deletion of your data when no longer relevant or incorrect.
  • Non-Discrimination: Not be discriminated against for exercising your privacy rights.

Additional state-specific rights

Certain U.S. states have enacted privacy laws providing specific rights to their residents. The following rights may apply depending on your state of residence:

  • Opt-out of Sale: We do not "sell" personal information as defined under state laws.
  • Opt-out of Profiling: Residents of certain states may opt out of automated processing used to evaluate aspects of their behavior.
  • Appeal: Residents of certain states may appeal declined requests.

California residents have additional rights to receive specific disclosures about data collection categories, limit the use of sensitive personal information, and receive information about third-party data sharing.

13. How to Exercise Your Rights    

To exercise any of your rights, please email us at privacy@easymate.ai. When submitting a request, please: specify which right(s) you wish to exercise, provide sufficient information to verify your identity, and describe your request with sufficient detail.

For deletion requests, you may also email us at privacy@easymate.ai.

We will respond within the timeframe required by applicable law (typically 45 days), and may extend this period by an additional 45 days when reasonably necessary with notice.

We may deny requests where permitted by law. For your protection, we may only implement requests for the personal data associated with your specific email address and may need to verify your identity.

Please note that we may need to retain certain information for record-keeping purposes and/or to complete any transactions that you began prior to requesting such change or deletion.

14. California-Specific Disclosures

The disclosures in this section apply solely to individual residents of the State of California and provide additional information about how we collect, use, disclose, and otherwise process personal information within the scope of the California Consumer Privacy Act of 2018, as amended, including its implementing regulations ("CCPA"). Unless otherwise expressly stated, all terms in this section have the same meaning as defined in the CCPA.

13.1 Sensitive Personal Information

Certain data elements we collect and use to provide the Services may be deemed "sensitive personal information" under CCPA. These include your username and password to access your account and the contents of any messages you send through our email integration feature. We do not use or disclose such sensitive personal information to “infer” characteristics as defined under the CCPA, or for any purpose other than that which is necessary to provide the Services as specified in the CCPA.

13.2 Sales and Sharing of Personal Information (Targeted Advertising)

We use cookies and similar tracking technologies that enable certain advertising networks, social media companies, analytics services, and other third-party businesses to collect and disclose your personal information directly from your browser or device when you visit or interact with our Services or otherwise engage with us online. In some cases, we may upload personal information to certain of these partners for advertising or analytics purposes.

To opt out of these “sales” or “sharing” of personal information (as these terms are defined under the CCPA or other applicable US state privacy laws), you must:

  • Toggle cookies off in our Cookie Preference Center, which may be accessed by clicking on "Cookie Preferences" in the footer of this webpage, or enable Global Privacy Control (“GPC”) on your browser; and

13.3 California Privacy Rights

As a California resident, you may be able to exercise the following rights in relation to the personal information about you that we have collected (subject to certain limitations at law):

  1. The Right to Know any or all of the following information relating to your personal information we have collected and disclosed in the last 12 months, upon verification of your identity:
  • The specific pieces of personal information we have collected about you;
  • The categories of personal information we have collected about you;
  • The categories of sources of the personal information;
  • The categories of personal information that we have disclosed to third parties for a business purpose, and the categories of recipients to whom this information was disclosed;
  • The categories of personal information we have sold or shared and the categories of third parties to whom the information was sold or shared; and
  • The business or commercial purposes for collecting, selling, or sharing the personal information.

  1. The Right to Request Deletion of personal information we have collected from you, subject to certain exceptions.

  1. The Right to Request Correction of inaccurate personal information.

  1. The Right to Opt Out of Personal Information Sales or Sharing to third parties now or in the future.

You also have the right to be free of discrimination for exercising these rights. However, please note that if the exercise of these rights limits our ability to process personal information (such as in the case of a deletion request), we may no longer be able to provide you with our Services or engage with you in the same manner.

13.4 How to Exercise Your California Privacy Rights

Please see Section 13.2 above to exercise your right to opt out of personal information sales or sharing.

To exercise your rights to know, correct, or delete, please submit a request by:

We will need to verify your identity before processing your request. In order to verify your identity, we will generally require either the successful login to your account (if applicable) and/or the matching of sufficient information you provide us to the information we maintain about you in our systems. Although we try to limit the personal information collected in connection with a request to know, correct, or delete, certain requests may require us to obtain additional personal information from you. In certain circumstances, we may decline a request to exercise the right to know, correct, or delete, particularly where we are unable to verify your identity or locate your information in our systems, or as permitted by law.

13.5 Minors Under Age 16

We do not sell or share the personal information of consumers we know to be less than 16 years of age. Please contact us at privacy@easymate.ai to inform us if you or your minor child is under the age of 16.

13.6 California’s "Shine the Light" Law

In addition to the rights described above, California's "Shine the Light" law (Civil Code Section §1798.83) permits California residents that have an established business relationship with us to request certain information regarding our disclosure of certain types of personal information to third parties for their direct marketing purposes during the immediately preceding calendar year.

15. Changes to Privacy Policy

Any information that we collect is subject to the Privacy Policy in effect at the time such information is collected. We may, however, revise the Privacy Policy from time to time. If a revision is material, as determined solely by us, we will notify you via email. The current version will always be posted to our Privacy Policy page.

16. EEA, UK, Swiss-Specific Disclosures

The disclosures in this section apply solely to residents of the European Economic Area ("EEA"), Switzerland, and the United Kingdom ("UK"), and describe how we collect, use, disclose, and otherwise process personal data about you. Unless otherwise expressly stated, all terms in this section have the same meaning as defined in the General Data Protection Regulation ("GDPR"). We are the controller of the personal data we hold about you in connection with your use of the Services.

16.1 Lawful Basis of Processing

We collect and process your personal data for purposes set forth in this Privacy Policy. Where required by law, we obtain your consent to use and process your personal data for these purposes. Otherwise, we rely on another authorized legal basis (including but not limited to the performance of a contract or legitimate interest) to collect and process your Personal Data.

16.2 Marketing and Advertising

From time to time, we may contact you with information about our products and services, including sending you marketing or advertising messages and asking for your feedback on our products and services. For some marketing or advertising messages, we may use personal data we collect about you to help us determine the most relevant marketing or advertising information to share with you. You can unsubscribe at any time from our marketing or advertising emails by clicking on the unsubscribe link (or similar opt-out language) at the bottom of the email or by contacting us at privacy@easymate.ai.

In addition, when you give us your consent, we may provide your information to third parties for targeted advertising or we may allow our advertising partners to collect data about you for that purpose using cookies or similar technologies. For more information, please see our Cookie Policy above.

16.3 Your Privacy Rights

You have the following rights in respect of your personal data that we hold: (i) right of access; (ii) right of portability; (iii) right to rectification; (iv) right to erasure; (v) right to restriction; (vi) right to withdraw consent; and (vii) right to object.

You also have the right to lodge a complaint with your local data protection authority. See Section 18 for information about how to contact your local data protection authority.

Due to the confidential nature of data processing, we may ask you to provide proof of identity when exercising the above rights.

17. Appeals Process for Rights Requests Denials

In some circumstances, we may deny your request to exercise one of these rights. For example, if we cannot verify that you are the account owner, we may deny your request to access the personal information associated with your account. As another example, if we are legally required to maintain a copy of your personal information, we may deny your request to delete your personal information.

In the event that we deny your request, we will communicate this fact to you in writing. You may appeal our decision by responding in writing to our denial email and stating that you would like to appeal. All appeals will be reviewed by an internal expert who was not involved in your original request. In the event that your appeal is also denied, this information will be communicated to you in writing. Please note that the appeal process does not apply to job applicants.

If your appeal is denied, in some US states, you may refer the denied appeal to the state attorney general if you believe the denial is in conflict with your legal rights. The process for how to do this will be communicated to you in writing at the same time we send you our decision about your appeal.
